These Terms of Use ("Terms") apply to your use of seismic-technologies.com (the "Site"), operated by Akora Cloud Inc. ("Seismic", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Scope
These Terms govern access to the Site and its content. They do not govern any production engagement, training-library deliverable, or other professional services Seismic may provide. Those are governed by separately executed agreements (MSA, SOW, DPA, and any related schedules).
Permitted use
You may view and read the Site for your personal or internal business use. You may share links to public pages of the Site. You may not:
- Copy, republish, or redistribute Site content for commercial purposes without our written permission.
- Use the Site or its content to train machine-learning models or build derivative products without our written permission.
- Reverse-engineer, scrape at high volume, or otherwise interfere with the operation of the Site.
- Use the Site in violation of any applicable law.
Intellectual property
All content on the Site — text, design, illustrations, logos, code, and trademarks — is owned by Akora Cloud Inc. or its licensors and protected by intellectual-property laws.
Nothing on the Site grants you any license or right to our intellectual property except as expressly stated in these Terms.
Submissions
If you submit a discovery-call request or otherwise send us information through this Site, you confirm that you are authorized to share that information and that doing so does not breach any obligation you owe to a third party. Information you send is handled per our Privacy Policy.
Third-party links
The Site may link to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party site, and a link does not imply our endorsement.
No warranty
The Site is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage. We do not warrant that the Site will be uninterrupted, error-free, or secure.
Limitation of liability
To the fullest extent permitted by law, in no event will Seismic be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total aggregate liability arising out of or related to the Site is limited to one hundred Canadian dollars (CA$100).
Indemnification
You agree to indemnify and hold Seismic harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the Site.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the courts located in Toronto, Ontario, and you consent to that jurisdiction.
Changes
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. Continuing to use the Site after a change constitutes acceptance of the updated Terms.
